Kathleen Duffield

Kathleen has been mediating commercial disputes, either as a litigator or mediator for nearly 30 years. As a litigator, she has represented clients in matters in B.C., Alberta, and Ontario, and has appeared at all levels of court in B.C. as well as the Supreme Court of Canada.

Having been counsel in a number of trials (one of which continued for over 100 days), Kathleen knows well the mental and financial toll of litigation, and the value to the parties of a well-facilitated, negotiated resolution.

With a broad litigation background, Kathleen is quick to understand the legal issues involved in an array of commercial disputes, together with risks of litigation for the parties involved.

Kathleen is known for working tirelessly with parties, and for her active, practical approach to mediation.  Ever mindful that the emotional dynamics underlying a dispute may be a factor in resolution, she works to foster an environment that permits the parties to communicate meaningfully, and make decisions confidently, thus optimizing the likelihood of resolution.

Kathleen offers services in-person throughout Canada, as well as virtually via Zoom or MS Teams. She is pleased, and considers it critical, to work with the parties to coordinate any pre-mediation preparation or conferences that may be called for – particularly in complex, multi-party matters.
